Personal data protection policy

AROHA TOURS RAPA NUI attaches particular importance to protecting the personal data of its visitors and customers. This policy explains what data is collected, why, for how long, with whom it is shared, and what rights you may exercise.

It has been drawn up in accordance with Regulation (EU) 2016/679 of 27 April 2016 (the "GDPR") and French Act No. 78-17 of 6 January 1978 as amended, known as the "Informatique et Libertés" Act.

No banking data is collected or stored by AROHA TOURS RAPA NUI. Card and bank transfer payments are handled directly by the banking institutions concerned.

Mandatory form fields are marked as such. The "message" field of the contact form is optional. We invite you not to include sensitive information there (health, opinions, beliefs) beyond what is strictly necessary for the tour to run smoothly.

3. Source of the data

Data is collected directly from you, through the website contact form, by email, by WhatsApp, by telephone, or through partner booking platforms when you use them (in particular GuideYourTrip). No data is purchased or obtained from data brokers.

Once these periods expire, data is deleted or archived in anonymised form.

5. Recipients and processors

Your data is neither sold, rented nor transferred to third parties for commercial purposes. It is accessible to David Tellier and, to the extent necessary for their task, to the following providers:

6. Transfers outside the European Union

As the business operates from Easter Island, your booking data is necessarily accessed and processed in Chile, a country not covered by an adequacy decision of the European Commission.

This transfer is based on Article 49(1)(b) GDPR: it is necessary for the performance of the contract concluded between you and AROHA TOURS RAPA NUI, since a guided tour on Rapa Nui cannot physically be organised without the guide having access to the booking information.

As regards providers liable to transfer data to the United States (Cloudflare, Meta), those transfers are governed by the European Commission's standard contractual clauses and, where applicable, by the EU–US Data Privacy Framework to which those companies have self-certified.

7. Your rights

Under Articles 15 to 22 GDPR and the Informatique et Libertés Act, you have the following rights:

  • Right of access — to obtain confirmation that your data is being processed and to receive a copy of it.
  • Right to rectification — to have inaccurate or incomplete data corrected.
  • Right to erasure — to request deletion of your data, subject to our legal retention obligations.
  • Right to restriction — to request the temporary freezing of contested processing.
  • Right to object — to object, on grounds relating to your particular situation, to processing based on legitimate interest.
  • Right to data portability — to receive the data you provided to us in a structured, machine-readable format, or to have it transmitted directly to another controller.
  • Right to withdraw your consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
  • Right to give directions concerning the fate of your data after your death (Article 85 of the Informatique et Libertés Act).

How to exercise these rights: by email to contact@arohatoursrapanui.com, by post to the address given in section 1, or through our representative in the European Union. You will receive a reply within one month, extendable by two months for complex requests. Proof of identity may be requested in the event of reasonable doubt as to your identity.

8. Complaint to a supervisory authority

If, after contacting us, you consider that your rights have not been respected, you may lodge a complaint with the data protection authority of your country of residence. In France this is the Commission Nationale de l'Informatique et des Libertés (CNIL):

9. Security

The website is served over HTTPS. The contact form is protected by anti-bot measures (Cloudflare Turnstile and a honeypot field). Access to booking data is restricted to the operator alone and protected by authentication. As no security measure is infallible, we recommend that you do not send us sensitive information over unencrypted channels.

10. Minors

The services offered are intended for adults. Bookings involving minors are made by a parent or legal guardian, who provides the necessary data under their own responsibility. No data is collected directly from minors.

12. Changes to this policy

This policy may be amended to reflect legal, regulatory or technical developments. The date of the last update appears at the top of the document. In the event of a substantial change, the customers concerned will be informed by email.

1. What is a cookie?

A cookie is a small file placed on your device — computer, tablet or phone — when you visit a website. It can be used to remember your preferences or to keep the site secure. This policy also covers equivalent technologies: pixels, tags and browser local storage.

2. Our approach

This website uses no advertising trackers, no analytics tools and no third-party services. We use neither Google Analytics, nor the Meta pixel, nor social network widgets, nor any advertising retargeting mechanism.

No data is sent to Google, Meta or any analytics provider whatsoever. Fonts are those already installed on your device: no file is downloaded from an external server. A Content Security Policy, applied at server level, technically prohibits the loading of any external resource.

Only cookies strictly necessary for the operation and security of the website are placed.

3. Cookies used

These cookies are essential to the functioning of the website. In accordance with Article 82 of the Informatique et Libertés Act, they are exempt from consent: they serve neither tracking nor advertising, and are not shared with anyone.

Cloudflare acts as a security and delivery provider. Its cookies relate to the protection of the website and are, on that basis, strictly necessary.

4. No cookies subject to consent

This website places no cookie requiring your authorisation. That is why no consent banner is imposed on you: there is nothing to accept or refuse.

Should we integrate a third-party service in the future — an interactive map, an embedded video or an analytics tool — a consent mechanism would be put in place beforehand, and this policy would be updated.

5. Fonts

The text on this website is displayed using the fonts already present on your device. No font is downloaded from a third-party server, so your IP address is not transmitted to any external supplier.

6. Managing cookies from your browser

You can at any time view, block or delete the cookies placed, from your browser's privacy settings. The procedure varies between browsers and is described in their help menu.

Blocking the cookies listed above may affect certain functions: your language choice will no longer be remembered, and the contact form may stop working.

Terms and conditions of sale

1. Purpose and scope

These general terms and conditions govern the tour guiding services offered by AROHA TOURS RAPA NUI – David Tellier (hereinafter "the Provider") on Easter Island: private guided tours, accompanied hikes, excursions and special cruise services.

Any booking constitutes unreserved acceptance of these conditions. They prevail over any other document, unless otherwise agreed in writing.

2. Nature of the services

The Provider supplies a single guiding service, lasting less than 24 hours, without accommodation or air travel. These services do not constitute a package holiday or a linked travel arrangement within the meaning of Directive (EU) 2015/2302 and Articles L211-1 et seq. of the French Tourism Code.

Tours are provided in French, Spanish or English by professional guides registered with the Chilean National Tourism Registry (SERNATUR no. 46446) and accredited as permanent guides by Ma'u Henua, the authority managing the Rapa Nui National Park.

3. Prices

Prices are quoted in euros, per service and according to the number of participants. They include guiding and ground transport on the island for the duration of the tour.

They do not include: the Rapa Nui National Park entrance ticket, meals and drinks, travel insurance, gratuities, or any bank charges levied by your own institution.

The applicable rate is the one in force on the day of booking. The Provider reserves the right to amend its rates at any time, with no effect on bookings already confirmed.

4. Booking

Bookings are made:

A booking is firm and final upon receipt of payment. Written confirmation is sent to the customer. In the absence of payment and without prior written agreement, the Provider reserves the right to cancel the booking.

5. Payment

Payment is made in euros, by bank card or by transfer to a bank account held in France. No banking data is stored by the Provider.

6. Cancellation by the customer

Any cancellation must be notified in writing, by email to resa@arohatoursrapanui.com or by WhatsApp on +56 9 7105 5729. The date of receipt of the notification is authoritative.

Refund terms are as follows, the period being counted from the start date of the service:

These terms apply whatever the cause of the cancellation, including a change of port of call decided by a cruise line. The Provider strongly recommends taking out travel insurance covering this risk.

Refunds are made within 14 days of acceptance of the cancellation, using the same means of payment as that used for the booking.

7. Cancellation or modification by the Provider

The Provider may be compelled to cancel, shorten or alter the itinerary of a service for reasons beyond its control: dangerous weather conditions, closure of sites by Ma'u Henua or CONAF, customary ceremonies, vehicle breakdown, illness of the guide, strikes, or any other event of force majeure.

In such cases, the Provider offers the customer, at the customer's choice:

  • postponement of the service to a date agreed between the parties;
  • an equivalent service;
  • or a full refund of the sums paid, free of charge.

Where a service is shortened after it has begun, the refund is calculated pro rata to the part not performed. The Provider does not cover ancillary costs incurred by the customer (flights, accommodation, other bookings).

8. No right of withdrawal

Important information. In accordance with Article L221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to contracts for leisure services supplied on a specific date or during a specific period. As the tours, hikes and excursions offered by the Provider fall within that category, you have no right of withdrawal after making your booking.

Only the cancellation terms set out in section 6 above apply, which are more favourable to the customer than a complete absence of refund.

9. Customer obligations and responsibility

The customer must attend at the agreed place and time. Any delay of more than 30 minutes without notice may result in cancellation of the service without refund.

The customer undertakes to follow the guide's instructions and to respect the rules of the Rapa Nui National Park and its archaeological sites, access to which is strictly regulated. The Provider may terminate a service, without refund, in the event of behaviour endangering the customer, the group, the guide or the heritage.

The customer must inform the Provider, at the time of booking, of any mobility limitation, medical condition or constraint liable to affect the running of the tour, in particular for hikes.

10. Insurance

There is no full hospital facility or insurance service on Easter Island. The Provider strongly recommends that every customer take out travel insurance covering cancellation, medical expenses, medical repatriation and hiking activities.

11. Complaints

Any complaint must be addressed to the Provider, by email to contact@arohatoursrapanui.com, which undertakes to reply within 30 days.

Failing a satisfactory solution, a consumer customer residing in the European Union may refer the matter free of charge to the European Consumer Centre of their country of residence. For France: www.europe-consommateurs.eu.

Data collected in connection with a booking is processed in accordance with our Personal data protection policy, available on this page.

13. Governing law and jurisdiction

This contract is governed by Chilean law, being the place of establishment and of performance of the service.

However, if you are a consumer residing in the European Union, that choice may not have the effect of depriving you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008, known as "Rome I".

Likewise, in accordance with Articles 17 to 19 of Regulation (EU) No 1215/2012, known as "Brussels I recast", you retain the right to bring proceedings before the courts of your place of domicile, and you may be sued only before those courts. Nothing in these conditions may restrict that right.

For non-consumer customers or customers residing outside the European Union, the Chilean courts have exclusive jurisdiction.

14. Amendment of these conditions

The Provider may amend these conditions at any time. The applicable conditions are those in force on the day of booking, a copy of which is provided to the customer on request.
